Introduction:
Please carefully review the following terms and conditions. By checking the box to sign up for one or more text messaging programs, you expressly consent to receive non-marketing and marketing text messages from Eric Bostic & Assoc, LLC (“EBA Payments”) and others texting on its behalf, including text messages made with an autodialer, at the telephone number(s) that you provide. You may opt out of these communications at any time. Consent to receive marketing text messages is not required to purchase any goods or services.
You also accept and agree to be bound by these SMS Terms and Conditions, the Website Terms of Use, our Privacy Policy, and any other applicable terms and agreements related to your use of EBA Payments’ services.
Program Description:
EBA Payments is independently owned and operated and may send you messages via an automatic telephone dialing system (“autodialer”) to deliver EBA Payments text messages to you. EBA Payments text messages are intended to provide you with information about upcoming services, appointments, and EBA Payments’ goods and services (e.g., updates, promotions, product launches, sweepstakes, and contests).
Message Frequency:
The number of EBA Payments text messages that you receive will vary depending on how many of EBA Payments’ text messaging programs you sign up to receive messages from. You will receive a maximum of five (5) marketing-related messages per month. The frequency of non-marketing messages will vary as such messages will be directly related to a scheduled or recently completed service call.
Cost:
Message and data rates may apply to each text message sent or received in connection with EBA Payments text messages, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans), in addition to any applicable roaming charges. EBA Payments does not impose a separate fee for sending its text messages.
Supported Carriers:
Supported carriers may change from time to time, but currently include AT&T, T-Mobile, Verizon Wireless, Sprint, Nextel, Boost, Alltel, US Cellular, and Cellular One, among others.
How to Opt-In:
To opt in to receive text messages from an EBA Payments text messaging program, please contact us at 1-704-325-8775 or select the appropriate option when scheduling services at
www.ebapayments.com or follow other instructions provided by EBA Payments.
How to Opt-Out:
To stop receiving text messages from a specific EBA Payments text messaging program, text STOP to the ten-digit number from which you no longer wish to receive messages. You will then receive confirmation of your opt-out from that program.
Your Mobile Telephone Number:
You represent that you are the account holder for the mobile telephone number(s) that you provide. You are responsible for notifying EBA Payments immediately if you change your number. You agree to indemnify EBA Payments for all claims or damages related to failure to notify us of number changes.
Access or Delivery to Mobile Network is Not Guaranteed:
Delivery of text messages may be delayed or affected by your mobile network. EBA Payments is not liable for issues caused by your mobile provider or network outages.

Eligibility:
To receive EBA Payments text messages, you must be a resident of the United States and at least 18 years of age. EBA Payments reserves the right to require proof of age.
Changes to Terms and Conditions:
EBA Payments may revise these terms at any time. Updates will be posted at
www.ebapayments.com. Continued use of the service indicates your acceptance of any changes.
Termination of Text Messaging:
EBA Payments may suspend or terminate your access to its text messaging services at its sole discretion without notice, particularly if terms are violated.
SMS Terms and Conditions:
Information collected through the SMS opt-in process will not be shared with third parties.
Types of SMS Communications:
You may receive internal communications from EBA Payments staff related to scheduling and appointments, as well as external communications with clients regarding services, installations, and product updates.
